TERMS OF SERVICE AGREEMENT
BETWEEN:
MANIX COMMUNICATIONS t/a Manix.co.za
(Hereinafter referred to as "The Company")
AND:
[Customer's Company Name]
(Hereinafter referred to as "The Customer")
REPRESENTED BY:
[Customer Representative's Full Legal Name]
(Hereinafter referred to as "The Customer Representative")
EFFECTIVE DATE: [Insert date of commencement]
1. SERVICES RENDERED:
The Company agrees to provide the services outlined in the attached quotation (Quotation Reference: [Insert quotation reference number]). These services will be provided on a month-to-month basis.
2. PAYMENT:
The Customer agrees to make payments on a monthly basis for the amount specified in the attached quotation. Payments are due on [Insert day - from date of commencement]. If the Customer cancels services before the next payment date, they will have access to their services until the next payment date.
3. DOMAIN REGISTRATION FEE:
In the event that the Customer cancels services within a year of initiation and intends to retain ownership of their domain, the Customer shall be liable for a domain registration fee of R125.
4. TRANSFER FEE:
Should the Customer request the transfer of services to another party, the Customer will be liable for a transfer fee of R625.
5. TERMINATION:
The Customer Representative may cancel this agreement at any time. The Company may terminate this agreement with 30 days' notice. In the event of termination, the Customer shall be responsible for any outstanding fees up to the termination date.
6. CHANGES TO THE AGREEMENT:
This agreement is subject to change with a 30-day notification to the Customer. The Company reserves the right to modify the terms and conditions of this agreement. Continued use of services after notification of changes constitutes acceptance of the modified terms.
7. GOVERNING LAW:
This agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the South African courts.
8. ENTIRE AGREEMENT:
This agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether oral or written, relating to the subject matter hereof.
IN WITNESS WHEREOF, the parties hereto have executed this Service Agreement effective as of the Effective Date.
